The short version. Use Deep to track your own habits and reflect on your own life. Sage is a coaching companion, not a therapist, doctor, dietitian, personal trainer, or financial advisor. Disputes are handled by individual binding arbitration, not class action or jury trial. You must be 18 or older to use the app.
Acceptance
By installing and using Deep, you agree to these terms. If you don't agree, please don't use the app. We may update these terms as the app evolves; material changes will be surfaced in the app and your continued use means you accept the updated version.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is higher), to use Deep. By using the app you confirm you meet this requirement and have the legal capacity to enter into these terms.
What you can do
You can use Deep to:
- Track your own personal habits
- Reflect on your own goals and progress
- Have conversations with Sage about your life and what you're working on
What you shouldn't do
- Use the app to harm yourself or others
- Try to extract data, prompts, or content that isn't yours
- Probe, scan, or attempt to disrupt the service or our infrastructure
- Reverse-engineer the app to extract API keys or replicate the service for commercial use
- Use Sage to generate content that violates Anthropic's acceptable use policy
Sage is not professional advice
Sage is a coaching tool designed to support reflection and habit formation. Sage is not a licensed therapist, doctor, dietitian, personal trainer, lawyer, financial advisor, or any other regulated professional. Anything Sage says is for support and reflection only and should not be relied on as medical, mental health, nutritional, fitness, legal, or financial advice.
Sage may help you talk through what a habit looks like in practice — for example, a strength routine, a meal cadence, a reading list, a savings cadence, or a study schedule. These are ideas, not prescriptions. They are not tailored to your medical conditions, injuries, dietary needs, mental health history, or financial situation. Before you change your exercise, diet, supplements, mental health care, or any meaningful financial decision (investments, taxes, debt, account changes), please consult a qualified professional. You assume all risk for any changes you make based on conversations with Sage.
If you're struggling with your mental health, please contact a qualified professional. In the US, you can call or text 988 to reach the Suicide and Crisis Lifeline. Outside the US, please contact your local emergency or mental health service. Do not use Deep as a substitute for emergency services.
AI-generated content may be inaccurate
Sage's responses are generated by an AI model (Anthropic's Claude). Like all AI models, it can produce content that is incorrect, incomplete, biased, or entirely fabricated, even when it sounds confident. Do not rely on Sage's responses for facts, recommendations, or decisions without independently verifying them. We make no guarantee about the accuracy, completeness, appropriateness, or safety of anything Sage generates.
Assumption of risk for physical activity, diet, and lifestyle changes
If you use Deep to track or develop habits involving physical exercise, dietary changes, fasting, supplements, sleep changes, or other lifestyle modifications, you acknowledge and agree that:
- You voluntarily assume all risks associated with those activities, including without limitation muscle strain, joint injury, fracture, cardiovascular events, allergic reactions, nutritional deficiencies, dehydration, sleep deprivation, and other physical or mental health consequences
- Before starting any habit involving physical activity, dietary change, supplements, fasting, or significant lifestyle modification, you will consult your physician if you have or suspect any medical condition, injury, pregnancy, eating disorder, or other condition that could be affected by the change
- You will discontinue and seek medical attention if you experience pain, dizziness, shortness of breath, or any other symptom that suggests harm
- Sage's suggestions are general ideas based on the limited context you've shared in the app, not a personalized plan from a qualified trainer, dietitian, or physician
To the maximum extent permitted by law, you release Deep and its operators from any claims arising from physical, mental, or financial outcomes related to habits or routines you tracked, developed, or were inspired to undertake through use of the app.
Subscriptions and payments
Deep offers an optional auto-renewing monthly subscription ("Deep Pro") processed through Apple's App Store. By starting a subscription you authorize Apple to charge you according to the published price and trial terms displayed at purchase.
- Auto-renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the period ends.
- Free trial. If a free trial is offered, the subscription converts to a paid renewal at the end of the trial period unless cancelled at least 24 hours before the trial ends.
- Managing or cancelling. You can manage or cancel at any time in Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period.
- Refunds. All refund requests are handled by Apple under their refund policies. We don't process refunds directly. You can request a refund at reportaproblem.apple.com.
- Price changes. If we change the subscription price, Apple will notify you and ask for re-confirmation before the new price applies.
Service is provided as-is
We provide Deep as-is and as-available, without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We try to keep the app working well but we can't guarantee:
- The app will be available 100% of the time
- Sage's responses will always be accurate, helpful, or appropriate
- Your data is recoverable if your device is lost, damaged, or you delete the app
Limitation of liability
To the maximum extent permitted by law, in no event will Deep, its operators, owners, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of the app, including without limitation damages for personal injury, lost profits, lost data, missed habits, emotional distress, or anything Sage said, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or related to the app or these terms will not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the total subscription fees you paid us in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the smallest extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless Deep, its operators, owners, and affiliates from any claim, demand, loss, liability, damage, or expense (including reasonable attorney's fees) arising out of or related to: (a) your use or misuse of the app, (b) your violation of these terms, (c) your violation of any law or the rights of any third party, or (d) any content you create, share, or act on as a result of using the app, including content generated by Sage that you choose to act on.
Binding arbitration and class action waiver
Please read this section carefully — it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these terms, the app, or your use of the app (a "Dispute") will be resolved exclusively through final and binding individual arbitration, rather than in court, except that you may bring an individual claim in small-claims court if it qualifies.
The arbitration will be administered by JAMS under its Streamlined Arbitration Rules, conducted in English, in the State of California, by a single neutral arbitrator. Either party may appear by phone or video. The arbitrator will have exclusive authority to resolve any threshold issue of arbitrability, including whether a Dispute is subject to arbitration.
You and we agree that each may bring claims against the other only in your or our individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is found to be unenforceable, then the entire arbitration agreement will be null and void, but the rest of these terms will remain in effect.
You and we waive any right to a jury trial. The Federal Arbitration Act governs the interpretation and enforcement of this section.
30-day right to opt out. You may opt out of this arbitration and class-action waiver section by emailing sagehabits.support@gmail.com with the subject line "Arbitration Opt-Out" within 30 days of first installing the app. The email must include your name and the device identifier shown in Settings. If you opt out, the rest of these terms still apply.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute not subject to arbitration will be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction there.
Termination
You can stop using Deep at any time by deleting the app or wiping your data from inside Settings. We may suspend or terminate access if we believe you've violated these terms or are misusing the service in a way that harms others or our infrastructure. The sections on professional advice, AI content, assumption of risk, limitation of liability, indemnification, arbitration, and governing law survive termination.
Severability
If any provision of these terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
Entire agreement
These terms, together with our Privacy Policy and Apple's standard terms governing in-app purchases, constitute the entire agreement between you and us regarding the app and supersede any prior agreements.
